Terms and Conditions – Alecto Direct Services

These Terms and Conditions (“Terms”) govern the Alecto Direct services provided by Alecto Consulting Pty Ltd (“Alecto,” “we,” “our,” “us”) to medical practices (“Client,” “you,” “your”) through our website and consulting services.

By purchasing an Alecto Direct package, you acknowledge that you have read, understood, and agreed to these Terms. If you do not accept these Terms, you should not proceed with our services.

Alecto reserves the right to update these Terms at any time, and your continued use of our services constitutes acceptance of any revised Terms. If we make significant changes, we will notify you via email.

1.0 ALECTO DIRECT PACKAGES

Alecto Direct offers three service packages:

1. DIY Recruit Package – Advertising only

2. Verified Recruit Package – Advertising & screening services

3. Hybrid Recruit Package – Advertising, screening & placement services

Each package includes a combination of job advertising, candidate screening, and recruitment support depending on the level of service selected.

Package Details for All Alecto Direct Packages

  • Each package runs for 3 months from the date of purchase.
  • Each package includes up to 5 individual job ads, which can be used for:
    • Permanent or locum GPs
    • Practice managers, nurses, or other roles within the practice
  • Alecto will write the job advertisements and send them to the Client for approval before publishing.
  • Ads can be updated or swapped within the 3-month period.

1.1 DIY Recruit Package (Alecto Direct – Advertising Only, Named Advertising Only)

Services Provided:

  • Alecto will write and publish the Client’s job advertisement(s) on our website for 3 months after receiving Client approval.
  • The advertisement will be publicly visible, and candidates will be encouraged to apply directly to the Client via the phone number and email provided in the job ad.
  • This package is only available with named advertising (i.e., the practice name and contact details must be displayed).

1.2 Verified Recruit Package (Alecto Direct – Advertising + Screening, Named Advertising Only)

Services Provided:

  • Alecto will write and publish the Client’s job advertisement(s) on our website for 3 months after receiving Client approval.
  • The advertisement will be publicly visible, and candidates will be encouraged to apply directly to the Client via the phone number and email provided in the job ad.
  • This package is only available with named advertising (i.e., the practice name and contact details must be displayed).
  • Alecto will confirm the candidate’s medical registration with the Australian Health Practitioner Regulation Agency (AHPRA) at the time of application, provided the candidate has supplied their full name and an AHPRA record exists.
  • Alecto will assess and communicate via email within 24 business hours whether the candidate is likely to obtain a Medicare provider number with the ability to rebate and refer.
  • A copy of the AHPRA registration status (as checked at the time of application) will be provided to the Client.

1.3 Hybrid Recruit Package (Alecto Direct – Advertising, Screening & Placement Services)

Services Provided:

  • Includes all services from Verified Recruit Package, plus additional placement services.
  • The Client must sign Alecto’s Service Agreement before advertising.
  • The Hybrid Recruit Package is a combination of advertising and professional recruitment services, providing:
    • Boosted advertising exposure, including featured placement in our newsletters, social media promotions, and targeted outreach to our candidate database.
    • Alecto’s active recruitment services, including engaging directly with candidates, screening, shortlisting, and managing communications on the Client’s behalf.
    • Access to Alecto’s recruitment team, who will act as an intermediary between the Client and candidates.

1.4 Advertising Options (Client Must Choose One)

Named Advertising:

  • Alecto will write and publish the Client’s job advertisement(s) on our website for 3 months after receiving Client approval.
  • The advertisement will display the Client’s name and contact details.
  • No placement fee is payable if the candidate contacts the Client directly via phone or email, and Alecto has not provided additional recruitment services.

Anonymous Advertising:

  • Alecto will write and publish the Client’s job advertisement(s) on our website for 3 months after receiving Client approval.
  • The advertisement will not display the Client’s name.
  • All applications will be handled by Alecto, and if the Client successfully hires a candidate who applied through Alecto, a placement fee is payable.

1.5 Candidate Referral Process

  • If a candidate specifically enquires about the Client’s vacancy, Alecto will encourage them to apply, provided they meet the job requirements.
  • However, if a candidate applies to Alecto for general positions in a region, Alecto may introduce them to other suitable vacancies.
  • The Client acknowledges that candidates may explore multiple opportunities, and Alecto does not guarantee exclusivity over a candidate’s interest.

1.6 Placement Fees

  • A placement fee will be due unless the candidate has applied directly, and Alecto has not provided any recruitment services beyond advertising.
  • Full registration support is included at no additional cost in instances where a placement fee applies. This includes assistance with:
    • Australian Medical Council (AMC) procedures
    • EPIC verification
    • RACGP registration
    • AHPRA registration
    • Medicare provider number applications
    • Other regulatory requirements

2.0 LIABILITY UNDER NAMED ADVERTISING

  • Alecto does not screen, endorse, or guarantee the suitability of any candidate that contacts a Client directly through named advertising.
  • All hiring decisions, due diligence, and background checks are the sole responsibility of the Client.
  • Alecto accepts no liability for any actions, omissions, or losses arising from the Client’s direct engagement with candidates, including but not limited to their performance, conduct, or misrepresentations.

3.0 WEBSITE SERVICE TERMS

  • While Alecto strives to maintain website accessibility and functionality, we do not guarantee continuous, uninterrupted, or error-free service.
  • Alecto is not liable for any losses, delays, or disruptions caused by website downtime, technical issues, or system errors. We reserve the right to suspend or discontinue access to any part of our website without notice.
  • Our website may include links to third-party sites. Alecto does not control or endorse external sites and is not responsible for their content, privacy practices, or any associated losses.

4.0 INTELLECTUAL PROPERTY RIGHTS

  • All content on Alecto’s website—including job advertisements and marketing materials created by Alecto—remains the property of Alecto Australia unless otherwise stated.
  • Alecto grants Clients a non-exclusive, revocable licence to use job advertisements solely for the purpose of advertising roles under their purchased Alecto Direct package.
  • Clients must not copy, reproduce, modify, or distribute Alecto’s content (including job ads) for use on other websites, job boards, or recruitment platforms without express written permission from Alecto.

5.0 FEES & PAYMENT

  • Fees for Alecto Direct services are non-refundable unless otherwise agreed and must be paid in full before the commencement of the service
  • Placement fees (where applicable) are due upon successful placement of a candidate, as per Alecto’s Service Agreement.

6.0 MEDICARE PROVIDER NUMBER DISCLAIMER

  • Alecto does not guarantee that any candidate will be granted a Medicare provider number.
  • Medicare policies and processing criteria are subject to change without notice.
  • If a candidate is unable to obtain a Medicare provider number as expected, Alecto is not responsible for any income losses or financial impact on the Client.

7.0 PRIVACY & CONFIDENTIALITY

  • Alecto complies with the Privacy Act 1988 (Cth) and protects all personal information collected.
  • Candidate applications sent directly to the Client must be treated as confidential.
  • The Client agrees not to share or misuse candidate information and to comply with Australian privacy laws when handling applications.

8.0 DISPUTE RESOLUTION

  • If a dispute arises, the Client should first contact Alecto at [email protected]
  • Both parties agree to attempt mediation before pursuing legal action
  • These Terms shall be governed by the laws of Australia

9.0 AGREEMENT TO TERMS

By proceeding with an Alecto Direct package, the Client confirms acceptance of these Terms. We reserve the right to modify these terms at any time. Changes will be posted on our website and effective immediately upon posting.

Terms and Conditions – Medicare Consulting Services

1.0 Introduction

1.1 These Terms and Conditions (“Agreement”) govern the purchase and use of Medicare billing training services (“Services”) provided through Alecto Consulting Pty Ltd (“Alecto”, “we”, “our”, or “us”).
1.2 By purchasing or using our Services, you (“Client”, “your”) agree to these Terms and Conditions.2.

2.0 Scope of Services

2.1 The Services provided include, but are not limited to, general advice on topics such as: (a) Medicare billing and compliance; (b) Strategies for improving the profitability of general practice; (c) Use of Medicare billing software for general practice management.
2.2 The Services are delivered by external consultants who are independent contractors and not employees or representatives of Alecto.

3.0 Limitation of Liability

3.1 The information provided in these training sessions is based on professional knowledge and experience at the time of delivery. However, due to the evolving nature of Medicare regulations and policies, Alecto does not guarantee that all advice will remain accurate, comprehensive, or suitable for every individual practice’s circumstances.
3.2 The Services do not constitute legal, financial, or accounting advice. The Client should seek independent professional advice before making any business, financial, or legal decisions.
3.3 Alecto and its consultants shall not be liable for any claims, losses, damages, or liabilities arising from the Client’s reliance on the information provided in the sessions.
3.4 The Client acknowledges that billing and management decisions remain solely their responsibility and that Alecto is not accountable for the outcomes of any billing practices implemented based on the training sessions.

4.0 Intellectual Property

4.1 All materials, content, methodologies, and information provided as part of the Services, including but not limited to presentations, guides, and documentation, are and shall remain the intellectual property of Alecto or its licensors.
4.2 The Client is granted a limited, non-exclusive, non-transferable licence to use the materials for internal business purposes only. No part of the materials may be reproduced, distributed, or shared with third parties without the express written consent of Alecto.
4.3 Any unauthorised use of Alecto’s intellectual property may result in legal action.

5.0 Independence of Consultants

5.1 The Client acknowledges that the consultants delivering the Services are independent contractors and not employees, agents, or representatives of Alecto.
5.2 Alecto is not responsible for any direct or indirect advice provided by the consultants beyond the agreed scope of Services.

6.0 N0 Guarantee of Results

6.1 The Client acknowledges that the training sessions are designed to provide general guidance and that Alecto does not guarantee specific financial, operational, or compliance outcomes.
6.2 Due to frequent changes in Medicare, AHPRA, and other regulatory frameworks, the information provided may become outdated or subject to interpretation. Alecto shall not be held liable for any discrepancies arising from such changes.

7.0 Payment and Cancellation Policy

7.1 Fees for the Services shall be payable in full at the time of booking unless otherwise agreed in writing.
7.2 The Client may cancel their purchase within 48 hours of the transaction for a full refund. Cancellations after this period will not be eligible for a refund unless covered under the Money-Back Guarantee (Clause 8).

8.0 Money-Back Guarantee

8.1 If the Client believes that the Services did not provide value to their organisation, they may request a full refund.
8.2 To be eligible for a refund under this clause, the Client must notify Alecto in writing within 14 days of the session, providing detailed reasons why the Services did not add value.
8.3 Alecto reserves the rightto assess the request and determine eligibility for a refund based on the provided justification.
8.4 This clause does not affect the limitation of liability in Clause 3 or the lack of guarantee of specific results outlined in Clause 6.

9.0 Confidentiality

9.1 Any confidential information disclosed by the Client during the training sessions will be handled in accordance with applicable privacy laws.
9.2 Alecto and its consultants shall not be liable for any unauthorised disclosure of information by the Client or third parties.

10.0 Indemnification

10.1 The Client agrees to indemnify and hold harmless Alecto, its employees, directors, affiliates, and consultants from any claims, liabilities, damages, or expenses arising from the Client’s use of the Services, including but not limited to incorrect Medicare billing practices or regulatory non-compliance.

11.0 Governing Law and Jurisdiction

11.1 This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Australia.
11.2 Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts of Australia.

12.0 General Provisions

12.1 Alecto reserves the right to modify these Terms and Conditions at any time. Any changes will be effective upon posting on our website.
12.2 If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Terms and Conditions – Registration Services

Welcome to Alecto Australia. These terms govern your use of our services, which include recruitment services and job advertisement postings on our website (“Services”). By using any of our Services, you agree to these terms.

Services Provided

  • Recruitment & Registration Services: We offer tailored recruitment solutions for employers/practices in the healthcare sector. Our role is to facilitate the matching of candidates with employers/practices. Fees are contingent upon the successful placement of a candidate, as detailed in our specific Service Agreement with your company.
  • Alecto Direct Job Posting Services: We provide a platform for employers/practices to advertise job vacancies. Alecto Australia will manage postings on their behalf.
  • Registration & Support Services for Doctors: We offer a range of services that are available directly to Doctors as they transition to Australia.

Cancellation

  • Cancellation by You:  You may cancel our services within the 48-hour cooling-off period for a full refund, provided that we have not yet started the service. After this period, cancellations will not result in a refund.
  • Cancellation by Us:  We reserve the right to cancel your service if you breach these terms and conditions or if unforeseen circumstances prevent us from delivering the service.

Pricing

  • Fees:  The fees for our services are as outlined on our website. All fees are subject to change without prior notice. You will be charged the fee applicable at the time you confirm your service.
  • Payment:  Payment must be made in full before the commencement of the service. We accept various forms of payment as indicated on our website.
